General Terms and Conditions (GTC)

The use of BalanceAlltag's services is subject to the following conditions. Please read them carefully.

1. Scope and Contractual Partners

These General Terms and Conditions (GTC) apply to all usage relationships between BalanceAlltag (hereinafter "Provider") and the users (hereinafter "Customers") of the digital content, advisory services, and community features offered on the website kimberlysnow.com.

2. Service Description

The Provider provides digital content (articles, guides, exercises) and, where applicable, personal advisory sessions on the topics of daily balance, stress management, and personal productivity.

  • The offered content serves for general information and personal development.
  • It does not constitute medical, therapeutic, psychological, or legal advice and cannot replace such advice.
  • The Provider does not guarantee the achievement of specific personal goals or results.

3. Rights and Obligations of the Contracting Parties

3.1 Obligations of the Provider

The Provider is obligated to provide the agreed services (e.g., provision of content, conduct of advisory sessions) diligently and to the best of its knowledge and belief.

3.2 Obligations of the Customer

The Customer is obligated to provide truthful information and to use the content only for personal, non-commercial use. Sharing access credentials or content with third parties is prohibited.

4. Payment Terms and Right of Withdrawal

For chargeable services (e.g., workshops, individual advisory packages), the prices displayed at the time of contract conclusion apply. Payment is made in advance via the specified payment methods.

For digital content not delivered on a physical data carrier, the right of withdrawal expires according to § 356 para. 5 BGB as soon as the Customer begins execution of the contract (e.g., by downloading or streaming). For services (advisory sessions), a right of withdrawal exists until 14 days after contract conclusion, provided the service has not yet been fully rendered.

5. Limitation of Liability

The Provider is fully liable for intent and gross negligence as well as for injury to life, body, or health. For slight negligence, the Provider is liable only in case of a breach of a material contractual obligation (cardinal obligation), which enables the fulfillment of the contract in the first place and on whose compliance the Customer may regularly rely. In this case, liability is limited to the foreseeable, typically arising damage.

Liability for indirect damages, lost profits, or data loss is excluded to the extent permitted by law.

6. Termination of the Usage Relationship

The Customer may discontinue the use of free services at any time. For paid subscriptions or packages, the agreed contract term applies. Termination before the end of this period is only possible for an important reason.

The Provider reserves the right to exclude users from further use of the services in case of violations of these GTC (e.g., abusive use, harassment of other users).

7. Amendment of the GTC and Final Provisions

The Provider reserves the right to amend these GTC with effect for the future. The amended conditions will be communicated to the Customer via email or by a clear notice on the website. They are deemed approved if the Customer does not object to the amendment within four weeks of notification.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes is, to the extent legally permissible, the seat of the Provider.
